[2] The present petition has been filed under Article-226 of the Constitution of India directing the O.C. of the Amtali Police Station, Agartala, West Tripura, for providing the keys of the common entrance gate which is under the custody of the said police station from 29.12.2025 till now of the common entrance gate of the rented house of the petitioner, which is thereby completely illegal and violation of legal right and also a direction be given to the police department i.e. the DGP, Govt. of Tripura to take necessary action against the officer in charge Amtali police station to handover the key of the lock placed in the common entrance gate of the rented house of the petitioner, so that the petitioner being a tenant can have their right to ingress and egress i.e. equivalent to right to access. [3] The petitioner has prayed for the following reliefs: “(i) Admit this petition; (ii) Call for records and after hearing the parties; Issue writ and/or order directing the Police Department i.e., The Director General of Police, Govt. of Tripura to take necessary action against the Officer in Charge, Amtali Police Station and to handover the key of the lock placed in the common entrance gate of the rented house of the petitioner as the said key is under the custody of the concern Police Officials of Amtali Police Station from 29/12/2025 till date, which is completely against the spirit of law and so that the petitioner being a tenant can have their right to ingress and egress i.e., Right to Access and such illegal activity of the Police officials is also directly violating the Fundamental Right i.e., Article 21 of the Constitution of India i.e., Protection of life and personal liberty for fair ends of justice. AND (iii) To pass any other order/orders or directing the respondent as Your Lordship deem fit and proper having regards to the facts and circumstances of the case.” [4] The case of the petitioner is that the petitioner namely Titu Rani Das along with her family are staying in a rented house as a tenant in the above noted address from 22.12.2023 to 21.12.2028 vide a rent agreement bearing No- 2174/DEC/2023 dated 22.12.2023 made in between the owner namely Jharna Biswas @ Chalana Routh and the tenant namely Titu Rani Das. The said rent agreement was made for 5 years and the whole rent of the rented house has been paid by the tenant i.e., the petitioner herein to the owner of the residence in the time of execution of the said agreement and accordingly the tenant with her family i.e., the petitioner started residing in the above noted address with bag and baggage. Moreover, from that time onwards the tenant i.e., the petitioner herein and the owner are staying together in the above noted address in a peaceful manner. [5] It is needed to be mention here that, an undue incident occurred on 29.12.2025 at about 02:00 PM (afternoon) wherein, the matter was in between the owner and the anti-social persons, but the petitioner being a tenant having no connection with the anti-social persons and the petitioner having only connection with the owner as a tenant. But the Amtali police station, police officials rather arresting the anti-social persons in the aforesaid incident but illegally took step and kept the key of the common entrance gate of the residential premise of the owner and for that reason now the tenant and her family are also suffering and could not be able to move inside their rented house as there is a lock placed by the police officials and the said key of such lock is also under the custody of the said police officials of Amtali police station. [6] Many a time the petitioner communicated with the Officer-in-Charge of the Amtali police station for handing over the key of the common entrance gate, so that the petitioner may start residing over there peacefully or the petitioner may took out their valuable items from the said rented house. But no positive action or response whatsoever has been taken by the said police officer. The petitioner, then finding no other alternative filed a written intimation dated 16.03.2026 addressing the Superintendent of Police, West Tripura and Director General of Police, Govt. of Tripura, but till date no reply or action has been initiated or conducted by the said Authority of police. Moreover, it is the failure of duty from the side of police authority. As such the petitioner humbly pray before this Court for directing the police department i.e., The DGP, Govt. of Tripura to take necessary action against the O.C. Amtali police station and to handover the key of the lock placed in the common entrance gate of the rented house of the petitioner, so that the petitioner being a tenant can have their right to ingress and egress. [7] Hence the present petition has been preferred by the petitioner before this Court for redress. [8] In view of above and having heard the learned counsel appearing for the parties, this Court is of the view that the writ petition is filed by making allegations against the Amtali P.S., the respondents herein, on the pretext that ease mental rights are infringed by way of locking the gate by the police since the petitioner has moved the local police station and also before the higher officials of the police department including the SP. But when nothing works out, the petitioner is before this Court making allegations against the arbitrary and highhanded action of the police involving in a civil dispute. It is further case of the petitioner that the owner and his tenant of the said property having some private dispute and as a consequence, the ease-mental rights of the petitioner by locking the gate was infringed and prayed to open the same. [9] Considering the said submissions, since it is a settled principle of law that the police personal cannot interfere in civil dispute, this Court has taken cognizance and requested the learned Advocate General to sensitize the matter with the concerned police station and also place relevant written instructions before this Court. [10] Today, when the case is called, both sides present. Learned Advocate General has placed the written instructions on record which indicate that the police in no-way concern with the said allegation infact, it was amongst the owner and the tenant of the said property involving civil dispute. However, it is also clarified in the written instruction that the gate is not closed and the same is open. In view of above submissions made by the learned Advocate General, this Court feels that nothing survives for adjudication in the present petition and thus, the same stands dismissed. [11] As such, the present petition stands dismissed. As a sequel, miscellaneous application, pending if any, shall stand closed. DR.T. AMARNATH GOUD, J A.
