Learned advocate for the petitioner submits that the petitioner was shown arrested on 17.06.2026. Learned advocate also submits that earlier, the petitioner was arrested in connection with another case for the offence under the BNS. So far as the present case is concerned, there has been no recovery from the present petitioner and the petitioner has been detained only on the basis of statement of a co-accused. As such, learned advocate prays that the petitioner may be enlarged on bail. Learned advocate for the State submits that there has been alleged recovery of 395 bottles of phensedyl. However, on a specific query from the Court, learned advocate submits that there is neither any CDR nor money
2 trail available in the case diary and the recovery was made from another accused. Learned advocate also added that the petitioner has been implicated only on the basis of statement of a co-accused. Having considered the materials available against the present petitioner and the statement of the co-accused, I am inclined to grant bail to the present petitioner. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Hiranmoy Sarkar shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, 8th Court, Barasat. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of North 24 Parganas without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1773 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
