The petitioner has preferred the instant petition seeking the following reliefs:-
“10.1 This Hon'ble Court may kindly be pleased to direct the respondent No.3/SDO to conduct fair trial in the appeal of the petitioners which is pending before him. 3 10.2 That, this Hon'ble Court may kindly be pleased to pass an order directing the respondent authorities not to dis-posses the petitioners from their respective shops. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent No.3 to take appropriate action against the culprit persons. 10.4 Any appropriate writ, direction or order may also kindly be passed in favour of the petitioners, which this Hon'ble Court deems fit in the circumstances of the case.”

Learned State counsel submits that, from the nature of the relief sought by the petitioners, it appears that they are essentially seeking consideration and adjudication of the appeal stated to be pending before respondent No. 3/Sub-Divisional Officer, Patan, District Durg (C.G.). He submits that, in view of the passage of time, the appeal may have already been decided. He further contends that in case the proceedings are still pending, the petitioners may place their objections and submissions before the concerned S.D.O., who shall consider and decide the same in accordance with law. If, however, the proceedings have already been concluded, the petitioners would be at liberty to avail the appropriate statutory remedy against the order so passed. 4
3. Having considered the submissions advanced by learned counsel for the State, this Court is of the view that no adjudication on the merits of the matter is warranted at this stage. Accordingly, if the proceedings before respondent No. 3 are still pending, the petitioners may place their objections and submissions before the said authority, who shall consider and decide the same in accordance with law. In case the proceedings have already been concluded, it shall be open to the petitioners to avail the appropriate statutory remedy in accordance with law. 4. With this observations and direction, the petition stands disposed of.
