Mr. Souma Bhattacharya Mr. Debjit Mukherjee Ms. Rupsa Ganguly ..for the petitioner By filing the present application, the petitioner seeks expeditious disposal of Complaint Case No. 35905 of 2018 under Section 138 of the Negotiable Instruments Act, 1881, pending before the learned 3rd Metropolitan Magistrate (now Judicial Magistrate), 3rd Court, Calcutta. It appears that, on an earlier occasion, the learned Magistrate had dispensed with the personal appearance of the accused. The complainant has already been examined; however, his cross-examination has not yet taken place. It further appears that the learned Magistrate has issued a warrant of arrest against the accused on account of his non- appearance before the Court and has fixed the matter for a report regarding the execution of the warrant of arrest, as the accused has not been attending the trial. In view of the aforesaid circumstances, no further order is called for. Accordingly, C.R.R. 3166 of 2026 is disposed.
