ORAL ORDER Accused No.1 in SC No.620 of 2026 pending before the Court of LXIX Additional City Civil and Sessions Judge, Bengaluru, arising out of crime No.34 of 2026 registered by Kamakshipalya Police Station, Bengaluru for the offences punishable under Section 109, 115(2) and 352 read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in crime No.34 of 2026 registered by Kamakshipalya Police Station, Bengaluru against petitioner and two others, based on the first information dated 17.01.2026 received from Puneeth.T., who injured victim in the present case. During the course of investigation, the petitioner was arrested on 18.01.2026 and remanded to

judicial custody. After completing investigation, charge sheet has filed against three persons and petitioner is arrayed as accused No.1 in the charge sheet. His bail application filed before the Trial Court in Crl.Misc.No.5093 of 2026 was rejected on 02.06.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, in respect of the alleged incident that took place on 17.01.2026, there is a case and counter-case registered in Crime No.34 of 2026 and Crime No.35 of 2026 by the very same police station. In both the FIRs, similar offences have been invoked. Investigation in Crime No.34 of 2026 is now completed, and perusal of the charge sheet material would go to show that it was the injured victim/CW1, who had fought against petitioner and his friends while they were consuming alcohol. Thereafter, he summoned CW2 to the said spot, who arrived with a knife and initially assaulted the petitioner. Even the

petitioner has suffered injuries in the incident in question. He is now in custody for the last more than 7 months. 5. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:
O R D E R
(i) The Criminal Petition is allowed.
The petitioner is directed to be enlarged on bail in SC No.620 of 2026 pending before the Court of LXIX Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.34 of 2026 registered by Kamakshipalya Police Station, Bengaluru for the offences punishable under Section 109, 115(2) and 352 read with Section 3(5) of BNS, 2023, subject to the following conditions:
a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two

sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
