1. The petitioner has preferred the instant petition seeking the following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to set aside impugned order dated 16.02.2021 (Annexure P/1) passed in revenue case no. 176/A-12/2014-2015 by learned tehsildar, in the interest of justice. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to constitute a committee under the supervision of SLR and conduct the demarcation of the petitioner land strictly in accordance to the Bhu Abhilekh Niyamawali, in the interest of justice. 10.3 That, the Hon'ble Court may kindly be pleased to call for the entire record of the case for kind perusal of this Hon'ble Court. 10.4 That, Cost of the petition may also be awarded to the petitioner. 10.5 Any other relief or relief(s) which this Hon'ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted.”

Learned counsel for the petitioner submits that the present petition may be disposed of with a direction to the concerned Revenue Authorities to constitute a team of Revenue Officers, including the concerned Tehsildar, to conduct demarcation of the land bearing Khasra Nos. 142/5 and 142/10, admeasuring 4800 sq. ft. (11 decimal), in accordance with Section 129 of the C.G. Land
3 Revenue Code and the relevant Rules.
He further submits that the demarcation may be conducted after due notice to the adjoining landowners, including respondent No. 4(a), and after affording adequate opportunity of hearing to all interested persons. It is also submitted that the proceedings may be conducted in the presence of the parties and, in case any person fails or refuses to participate despite due notice, such fact may be duly recorded in the demarcation proceedings in the presence of witnesses. 3. Learned State counsel submits that, if the petition is disposed of with an appropriate direction to the concerned Revenue Authorities to undertake the demarcation in accordance with the applicable provisions of law, the State has no objection to the same. 4. Learned counsel appearing for the respondent No. 4 (a) has no objection to the demarcation being conducted by the concerned Revenue Authorities in accordance with law, after due notice and opportunity to all concerned persons. 5. Having considered the submissions made by learned counsel for the parties, the petition is disposed of with a direction to the concerned Revenue Authorities to constitute a team of Revenue Officers, including the concerned Tehsildar, and undertake demarcation of the land bearing Khasra Nos. 142/5 and 142/10, admeasuring 4800 sq. ft. (11 decimal), strictly in accordance with law. Before undertaking the exercise, due notice shall be given to
4 the adjoining landowners, including respondent No. 4(a), and reasonable opportunity shall be afforded to all concerned persons to participate in the proceedings. The demarcation shall, as far as practicable, be conducted in the presence of the parties. In case any duly noticed person fails or refuses to participate, the same shall be recorded in the proceedings in the presence of witnesses. The entire exercise shall be completed within a period of 60 days from the date of receipt of a copy of this order. 6. With this observations and direction, the petition stands disposed of. Sd/-
