Learned advocate appearing for the petitioner submits that the petitioner has complied with the provisions of Section 35(3) of the BNSS. Learned advocate for the de facto complainant raises objection and submits that there are other cases. State has produced the report as well as the case diary. I find that the other cases are under the Payment and Settlement Act which are complaint cases. 2 Having considered that the investigation is proceeding under sections wherein prescribed punishment are below seven years, I am inclined to extend the benefit of anticipatory bail. As such, the prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner, namely, Sonalina Mukherjee shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, the petitioner shall make herself available as and when required by the investigating officer of the case. Thus, CRM(A) 2683 of 2026 is allowed. Report and Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
