JUSTICE RAVI V HOSMANI ORAL ORDER Seeking for quashing of FIR in Crime no.10/2020 registered by Thirumalashettahalli Police Station for offences punishable under Sections 143, 323, 324, 504, 506, 354B read with Section 149 of Indian Penal Code, 1860 (IPC) presently stated to be pending on file of Additional Civil Judge (Jr.Dn.) & JMFC, Hosakote, Bengaluru Rural District, this petition is filed. 2. Sri D. Ashwathappa, learned counsel for petitioners- accused and Sri Manoj SN., learned counsel for respondent no.2-complainant jointly submit that during pendency of above - 3 - HC-KAR CNR: KAHC010093002020 NC: 2026:KHC:45687 CRL.P No. 1437 of 2020 petition, there was settlement between parties as per joint memo is filed and application under Section 320(2) of Code of Criminal Procedure, 1973 (CrPC) for compounding. 3. It was submitted that except offences under Sections 324 and 354B of IPC, other offences were compoundable. It was submitted that petitioners and complainant were relatives/neighbours and in order to give quietus to dispute, permission for compounding of offences under Sections 324 and 354B of IPC also may be granted. 4. It was submitted, pursuant to settlement arrived at between parties, respondent no.2 has agreed to withdraw complaint lodged before Thirumalashettihalli Police Station, which was registered in Crime no.10/2020 and has no objection for proceedings arising therefrom being quashed. It was submitted, parties have resolved all their disputes relating to subject matter of above proceedings and do not have any further grievance against each other in respect of said dispute. Therefore, jointly prayed for allowing petition and quashing impugned proceedings. - 4 - HC-KAR CNR: KAHC010093002020 NC: 2026:KHC:45687 CRL.P No. 1437 of 2020 5. Learned counsel further submitted that petitioners as well as complainant are present and identify them. 6. On interaction, parties stated that terms of compromise have been explained to them and after understanding, they have affirmed same out of their free will and volition without there being any threat, coercion and/or undue influence from anyone. 7. Sri Mahesha P., learned HCGP for respondent no.1- State submitted though offences punishable under Sections 324 and 354B of IPC were non-compoundable, taking note of settlement, appropriate orders may be passed. 8. Joint memo/Terms of compromise reads as under: "JOINT MEMO The Petitioners and Respondent No. 2 above named respectfully submit as follows: 1. That the above Criminal Petition is pending before this Hon'ble Court and arises out of the complaint registered before Thirumalashettihalli Police Station in Crime no. 10/2020. 2. That during the pendency of the above proceedings, the Petitioners and Respondent No. 2 have amicably settled their disputes and differences amongst themselves. 3. That pursuant to the settlement arrived at between the parties, Respondent No. 2 has agreed to - 5 - HC-KAR CNR: KAHC010093002020 NC: 2026:KHC:45687 CRL.P No. 1437 of 2020 withdraw the complaint lodged before Thirumalashettihalli Police Station, which was registered in Crime No. 10/2020, and has no objection for the proceedings arising therefrom being quashed. 4. That the settlement between the parties is voluntary, mutual and without any force, coercion or undue influence. The parties have resolved all their disputes relating to the subject matter of the above proceedings and do not have any further grievance against each other in respect of the said dispute. 5. The parties therefore jointly pray that this Hon'ble Court may be pleased to allow the Criminal Petition and quash the proceedings arising out of Crime No. 10/2020 registered by Thirumalashettihalli Police Station, in the interest of justice and equity. 6. The parties further submit that the present Joint Memo is being filed voluntarily and with full knowledge of its contents and consequences. WHEREFORE, the Petitioners and Respondent No. 2 most respectfully pray that this Hon'ble Court may be pleased to take this Joint Memo on record and, in terms of the settlement arrived at between the parties, quash the proceedings arising out of Crime No. 10/2020 registered by Thirumalashettihalli Police Station, in the interest of justice and equity." 9. Heard learned counsel and perused application as well as material on record. 10. As rightly pointed out, offences under Sections 143, 323, 504, 506 read with Section 149 of IPC are compoundable. Though offences under Sections 324 and 354B of IPC are non- compoundable, allegations in complaint as well as imputations indicate that incident occurred was purely between complainant - 6 - HC-KAR CNR: KAHC010093002020 NC: 2026:KHC:45687 CRL.P No. 1437 of 2020 and accused, who are stated to be relatives/neighbours. There is no allegation of use of weapon for assault or to disrobe complainant. Allegations reveal dispute is purely inter parte without societal impact. Therefore, in view of settlement arrived at and to secure ends of justice, this appears to be fit case for grant of permission for compounding of offences under Sections 324 and 354B of IPC. 11. Consequently, joint memo is accepted. Application under Section 320(2) of CrPC for compounding and petition are allowed, FIR in Crime no.10/2020 registered by Thirumalashettahalli Police Station for offences punishable under Sections 143, 323, 324, 504, 506, 354B read with Section 149 of IPC, presently stated to be pending on file of Additional Civil Judge Junior Division & JMFC, Hoskote, Bengaluru Rural District, stand quashed.
