1. By way of the instant petition, the petitioner has called in question the inaction on the part of the respondent authorities for not considering his case for promotion on the post of Time Keeper (Contingency Establishment) or on the post of Assistant Grade-III (Regular Establishment).

Learned counsel for the petitioner submits that the petitioner was initially appointed as Chowkidar under Contingency Establishment and, after rendering the requisite length of service, submitted his claim for promotion to the post of Time Keeper. It is submitted that similarly situated employees have been promoted to the post of Time Keeper/Class-III posts and, in this regard, the petitioner has also placed relevant documents on record. He further submits that the representation submitted by the petitioner before the Respondent No.4 is pending
consideration. He, therefore, prays that the petition may be disposed of with a direction to the competent authority to consider and decide the representation in accordance with law.
3. Learned State counsel submits that, if the representation is pending before the competent authority, the same shall be considered and decided in accordance with law within a period of 50 days.

Considering the submissions made by learned counsel for the parties, the petition is disposed of with a direction to respondent No.4- Superintending Engineer, Department of Public Works (B/R), Circle Ambikapur, District Surguja, to consider and decide the representation submitted by the petitioner, if pending, in accordance with law, within a period of 50 days from the date of receipt of a copy of this order.
