Mr. Suman De …for the petitioner Mr. Subrata Mukherjee ..for the State Mr. Aniket Mitra …for the WBSEDCL Mr. De, learned Counsel appearing on behalf of the petitioner, submits that the present case came to be registered on the allegation of theft of electricity and that the petitioner has been falsely implicated in the case. However, he submits that a final assessment bill has been prepared, wherein an amount of Rs.1,30,283/- has been shown as payable by the petitioner. He submits that the petitioner is ready and willing to pay half of the amount mentioned in the final assessment bill. He prays for pre arrest bail of the petitioner. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. In these circumstances, in view of such undertaking, I am of the view that the benefit under Section 482 of the BNSS can be extended in favour of the petitioner, subject to the condition that the petitioner shall deposit half of the amount mentioned in the final assessment bill within seven days from date. Accordingly, the application for anticipatory bail of the petitioner is allowed. 2 In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the Electricity Act at Tamluk, Purba Medinipur, and shall also be subject to the conditions as laid down under Section 482(2) of the BNSS, 2023, and on the further conditions that the petitioner shall not threaten or intimidate the witnesses and shall co-operate with the investigation. The application for anticipatory bail is, thus, disposed of. (Partha Sarathi Chatterjee, J.)
