GA Hon'ble Shri Justice Naresh Kumar Chandravanshi, J Order on Board (23rd September, 2026) This is the first bail application under Section 483 of BNSS, 2023 by the applicant for grant of regular bail as he is arrested on 9.7.2026 in connection with Crime No.154/2023 registered at Police Chowki- 2 Kanakbira, Police Station-Sarangarh, Distt. Sarangarh-Bilaigarh, for the offence punishable under Sections 420, 409, 34 of IPC. 02. Allegation against the applicant, in brief, is that he along with other two co-accused namely Umesh Chauhan and Vikas Khare cheated the victims namely Botbai Soni, Umrautin Bai, Ramesh Sarthi and 3-4 other persons by taking loan in their names after making their forged signatures and thereafter misappropriated the loan amount. Based on the above, the aforesaid crime was registered against the applicant and other two co-accused under Sections 420, 409, 34 of IPC and after investigation, charge sheet has been filed against them. 03. Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in this case. At the fateful time, the applicant was Manager of SBCL Micro Finance Company from where the said loan was taken. The loan documents were submitted by the co-accused Umesh Chauhan and Vikas Khare. Being Manager, the applicant had sanctioned the loan only and he was not aware of the alleged forged signatures of the victims. He further submits that the co-accused Umesh Chauhan and Vikas Khare have been granted bail by this Court vide order dated 7.10.2023 passed in MCRC Nos. 5670/2023 and 5709/2023 respectively. The applicant is in jail since 9.7.2026; he has no criminal antecedents at all; charge sheet has already been filed and conclusion of the trial is likely to take some time. Therefore, he prays for grant of bail to the applicant. 3 04. Per contra, learned counsel appearing for the State opposes the bail application and submits that the applicant is one of the main culprit in the alleged act of cheating, therefore, his bail application is liable to be rejected. 05. Heard learned counsel for the parties and perused the case diary. 06. Having considered the fact that two co-accused namely Umesh Chauhan and Vikas Khare have already been granted bail by this Court; the applicant is in jail since 9.7.2026; he has no criminal antecedents; charge sheet has already been filed, as such, there is no requirement of any custodial interrogation of the applicant; and that conclusion of the trial is likely to take some time, without expressing any opinion on merits of the case, this Court is inclined to allow the instant bail application. Accordingly, the bail application of the applicant is allowed. 07. Let the Applicant – Chummesh Kumar Kashyap, involved in Crime No.154/2023, registered at Police Chowki-Kanakbira, Police Station-Sarangarh, Distt. Sarangarh-Bilaigarh (C.G.) for the offence punishable under Sections 420, 409, 34 of IPC be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with two sureties in the like sum to the satisfaction of the Court concerned with the following conditions:- 4 (a) the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) the applicant shall not act in any manner which will be prejudicial to fair and expeditious trial, (c) the applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and his sureties shall submit a copy of their Aadhar Card along with a coloured postcard full size photo having printed the Aadhar number on it, which shall be verified by the trial Court. (e) the applicant shall not involve himself in any offence of similar nature in future.
