Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with the Saktigarh Police Station case no.193 of 2026 dated 10.06.2026 under Sections 126(2)/115(2)/308(5) 351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

1. Parties are present through their respective Counsel.
2. Upon hearing the rival contentions and perusal the materials in the Case Diary it appears that the Petitioner is alleged to have extorted Rs.50,000/- from the de facto complainant. The Case Diary does not contain in the injury report.
3. It has been submitted by the learned Counsel for the Petitioner that the Petitioner has been falsely implicated in this case out of political grudge.

4. Considering the nature of allegations as well as materials in the Case Diary I am of the opinion that custodial interrogation of the petitioner may not be necessary.
5. Accordingly, anticipatory bail prayer is allowed.
6. In the event of arrest, the petitioner, namely, SK MD HABIB @ MAHAMMAD HABIB shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, 1973 corresponding to Section 482 (2) of the BNSS, 2023 and on further conditions that the petitioner shall co-operate with the investigation and shall not threaten or intimidate the witnesses. The petitioners shall meet the I.O. once a week till submission of report in final form. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date.
7. The application for anticipatory bail being CRM (A) 2540 of 2026, is thus, disposed of.

8. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
