1. By way of filing the instant petition i.e. S.B. Criminal Writ Petition No.247/2019, a challenge has been led to the impugned
[2026:RJ-JP:14039] (2 of 2) [CRLW-247/2019]
order dated 14.02.2019 passed by the Rural Development & Panchayati Raj Department (Panchayati Raj) wherein directions have been given for issuance of prosecution sanction against the petitioner.
2. At the very outset, learned Public Prosecutor apprised this Court that after investigation the Police has not submitted charge- sheet against the petitioner only on the technical ground that the case pertains to Prevention of Corruption and the local Police has no jurisdiction to investigate the matter, hence, ‘Negative’ report has been submitted narrating all these facts. Under the changed circumstances, the instant petition has become infructuous. He further submits that unless and until the Anti Corruption Bureau proceeds against the petitioner, the instant petition would be pre- mature and the same would not be maintainable. Hence, the same is liable to be rejected.
3. Considering the above, the instant petition stands disposed of granting liberty to the petitioner to move an application for revival of the instant petition in S.B. Criminal Writ Petition No.247/2019, in case the matter is investigated by the Anti Corruption Bureau and in case the charge-sheet is submitted by the Anti Corruption Bureau against the petitioner.
4. Looking to the facts and circumstances of the case, S.B. Criminal Writ Petition No.1082/2018 also stands disposed of.
