The Court made the following ORAL ORDER:
This Writ Petition is filed to set aside the enquiry report dated 20.05.2013 of the Respondent No.4 and to direct the Respondent No.2 to appoint any other enquiry officer to conduct the affairs of the Respondent No.6 Bank. 2. On 16.06.2026, there is no representation on behalf writ petitioner. Therefore, this Court had directed the registry to list this matter on 23.06.2026 under the caption for dismissal. Even today also none appears for the writ petitioner. 3. On the other hand, learned counsel for the Respondents has submitted the written instructions dated 22.06.2026. The same is taken on record. Relevant portion of the written instructions is usefully extracted hereunder:
“It is further submitted that, based on the findings of the said enquiry report, surcharge proceedings were initiated and hearings were conducted by the Deputy Registrar of Cooperative Societies, Ananthapuramu. Thereafter, a surcharge order was passed fixing liability on the persons found responsible, and consequential action under the provisions of the Andhra Pradesh Cooperative Societies Act, 1964, has been initiated and it presently under process.”

The above extract would indicate that the enquiry was already completed and surcharge order was already passed by fixing the liability on the persons found responsible, and consequential action under the provisions of the Andhra Pradesh Cooperative Societies Act, 1964, has been initiated and it presently under process. Therefore, this Court is of the view that keeping pending this Writ Petition no purpose would serve. 5. Accordingly, this Writ Petition is dismissed as infructuous. No order as to costs. 4
