ORAL ORDER
1. Accused in Crime No.365/2026 registered by Kengeri Police Station, Bengaluru, for the offences punishable under Sections 132 and 121(2) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.365/2026 was registered by Kengeri Police Station, Bengaluru, for the aforesaid offences against the driver of the auto rickshaw bearing Reg.No.KA41AA2532. During the course of investigation of the said case, petitioner was arrested and remanded to judicial custody on 03.08.2026. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.8061/2026 was rejected on
17.08.2026. Therefore, he is before this Court. 4. Petitioner is the driver of auto rickshaw bearing Reg.No.KA41AA2532 and the first informant is a police constable (traffic). On 02.08.2026, when the first informant was discharging his duties near Jaya Ramadasa Railway

Junction, at about 06.30 p.m., petitioner, who came in his auto rickshaw bearing Reg.No.KA41AA2532 took a u-turn near the junction and parked his auto rickshaw on the right side. Since the auto rickshaw of the petitioner was causing traffic jam, first informant allegedly asked him to remove his auto rickshaw from the said spot. Petitioner allegedly informed the first informant that a KSRTC bus had dashed against his auto rickshaw and therefore, he had parked his auto rickshaw at the said place. At the same time, police, who came in Hoysala jeep started shouting at the petitioner and therefore, he abruptly tried to remove his auto rickshaw from the said spot and at that time, he allegedly drove his auto rickshaw over the right foot of the first informant and caused injuries. Immediately the first informant boarded the auto rickshaw of the petitioner and asked the petitioner to stop the vehicle but the petitioner drove the auto rickshaw in a zigzag manner and made the first informant fall from the auto rickshaw causing injuries to him. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences. - 4 -

Learned HCGP has submitted that first informant has suffered only simple injuries in the incident in question. 6. Petitioner is 19 years old having no other criminal antecedents. He is in custody from 03.08.2026 onwards. He is an auto rickshaw driver by profession. Considering the nature of allegations against him and the background in which the incident had taken place, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-
7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.365/2026 registered by Kengeri Police Station, Bengaluru, for the offences punishable under Sections 132 and 121(2) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the

Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
