Justice Sushma Sawant Order on Board Per Parth Prateem Sahu, J. 21/09/2026 1) Parties present before this Court submits that they have entered into a settlement outside the Court before the Community Meeting held on 18/04/2026 and according to the settlement arrived at between the parties, the respondent has paid Rs.5 Lakhs to the appellant towards permanent alimony. 2) The appellant also submits that today, the respondent has handed over to her a Cheque bearing No.671208 of Rs.5 Lakhs, drawn on State SATISH TUMANE Digitally signed by SATISH TUMANE Date: 2026.09.23 14:39:19 +0530

The appellant further submits that in the aforementioned facts of the case, she did not want to press this appeal, which is an appeal arising out of the judgment and decree dated 19/08/2025 passed by the learned Family Court, Rajnandgaon in Civil Suit No.207-A/2022, allowing the application filed by the respondent under Section 13(1) of the Hindu Marriage Act, 1955. She, however, submits that if the cheque handed over to her by the respondent is dishonoured, the liberty may be granted to her for filing an appropriate application for revival of this appeal. 3) Submission made by the appellant is not opposed by the respondent. 4) At this stage, learned counsel appearing for the respective parties submit that today, the parties have filed a joint application under Order 23 Rule 3 CPC, which is supported by an affidavit of both the parties. 5) In view of the facts and circumstances of the case, submissions made by the parties as also learned counsel for the respective parties, the First Appeal (MAT) No.395/2025 is dismissed as not pressed, reserving liberty to the appellant, as prayed for.
