ORAL JUDGMENT

MFA No. 8625 of 2025 Aggrieved by the judgment and decree passed by the learned Principal Judge, Family Court, Kolar (‘the Family Court’ for brevity), in M.C. No.147/2023, whereby the petition filed under Section 13(1)(ia) of the Hindu Marriage Act, 1955 (‘the Act’ for brevity), was allowed and the marriage solemnized between the petitioner and the respondent on 03.03.2021 at Sri Nandini Palace, Mulabagal Main Road, near the Deputy Commissioner’s Office, Kolar, was dissolved by granting a decree of divorce and further directing the petitioner to pay a sum of Rs.20,00,000/- towards permanent alimony to the respondent/wife, the petitioner/husband has preferred the present appeal under Section 19 of the Family Courts Act,
1961. Notice was issued in the appeal and the respondent entered appearance and contested the appeal, seeking dismissal of the same.

2. The respondent/wife, being aggrieved by the very same judgment and decree passed by the Family Court, Kolar, in M.C. No.147/2023, insofar as the petition under Section 13(1)(a) of the Hindu Marriage Act was allowed and the marriage between the parties was dissolved by a decree of divorce and the husband was
directed to pay Rs.20,00,000/- towards permanent alimony, has preferred the present appeal. The grievance of the petitioner-wife is confined principally to the quantum of permanent alimony. She has sought enhancement of the amount of permanent alimony from Rs.20,00,000/- to Rs.1,00,00,000/-, or such higher amount as this Court may deem appropriate in the facts and circumstances of the case. 3. The respondent/wife has also preferred MFA No.9318/2025, questioning the aforesaid judgment and

decree, whereby the petition under Section 13(1)(ia) of the Hindu Marriage Act as well as the counter-claim filed by the respondent came to be allowed in part and the marriage between the parties was dissolved by a decree of divorce, with a direction to pay Rs.20,00,000/- towards permanent alimony. In the said appeal, the petitioner has sought setting aside of the judgment and decree insofar as it grants the relief of divorce and has further sought expunging of the adverse observations and findings recorded against her in the judgment. 4. When the appeals came up for consideration on 06.08.2026, at the request and with the consent of the parties, the matter was referred to the learned Senior Counsel, Sri P.P. Hegde, for mediation with a view to resolving the dispute between the parties, particularly with regard to the quantum of permanent alimony payable to the respondent-wife. The parties were accordingly directed to approach the learned Senior Counsel through their respective counsel. - 7 -

Pursuant thereto, the petitioner in MFA No.8625/2025 filed a memo stating that the appeal may be permitted to be withdrawn, as the parties had settled their disputes and all claims in MFA No.9101/2025 by filing an application under Section 13-B of the Act. In view of the said memo, MFA No.8625/2025 is dismissed as withdrawn. 6. In MFA No.9101/2025, the parties have filed an application under Section 13-B of the Act seeking dissolution of their marriage by mutual consent. In the said application, the parties have arrived at a settlement and have agreed to dissolve the marriage on the terms contained therein.
The parties have also filed their respective affidavits in support of the application. 7. Similarly, in MFA No.9318/2025, the petitioner- wife has filed a memo stating that, in view of the settlement arrived at between the parties in MFA No.9101/2025 and the application filed under Section 13-B

of the Hindu Marriage Act, nothing further survives for
consideration in the said appeal. Accordingly, MFA No.9318/2025 is also dismissed as withdrawn.
8. In view of the settlement arrived at between the parties and the application filed under Section 13-B of the Act, nothing further survives for consideration in MFA Nos.8625/2025 and 9318/2025. However, having regard to the terms of settlement arrived at between the parties and the application filed under Section 13-B of the Act, we deem it appropriate to pass an
order in MFA No.9101/2025.
9. Accordingly, the application filed under Section 13-B of the Hindu Marriage Act is allowed. The marriage solemnized between the petitioner and the respondent on 03.03.2021 at Sri Nandini Palace, Mulbagal Main Road, near the Deputy Commissioner’s Office, Kolar, is hereby dissolved by a decree of divorce by mutual consent, in terms of the settlement arrived at between the parties.

10. The learned Senior Counsel, Sri P.P. Hegde, has filed a memo stating that, pursuant to the reference made for mediation, the parties have amicably resolved and settled their disputes. It is further stated that the parties have agreed to file a petition and an application under Section 13-B of the Act, 1955, seeking dissolution of their marriage by a decree of divorce by mutual consent. In view of the settlement so arrived at, no dispute remains between the parties insofar as the matter referred to mediation is concerned. The memo is taken on record.
11. This Court places on record its deep appreciation for the valuable efforts made by the learned Senior Counsel, Sri P.P. Hegde, who, pursuant to the reference, mediated between the parties and facilitated an amicable resolution of the matrimonial dispute. The efforts of the learned Senior Counsel in bringing about an amicable settlement between the parties are commendable. A copy of this order shall also be furnished to the learned Senior Counsel, Sri P.P. Hegde.

12. MFA No.9101/2025 is accordingly disposed of, in terms of the aforesaid settlement.
