1. According to the allegations made in the First Information Report, 50 bottles of narcotic contrabands were recovered and the instant case was started. 2. Learned advocate appearing for the petitioner seeks bail on parity with the accused who was arrested with narcotic contrabands. 3. The said accused was granted bail by this Court by an order dated August 1, 2026 in CRM (NDPS) 1739 of 2026. 4. Learned advocate appearing for the State opposes the prayer for bail. 5. It transpires from the materials on record in the case diary that the investigation of the case has ended in a charge
sheet. Nothing was recovered from the possession of the present petitioner. 6. The present petitioner has been implicated in this case on the basis of the statement of the co-accused made in the custody. 7. Charge sheet has already been submitted. 8. Considering the aforesaid facts and circumstances of the case, the prayer for anticipatory bail of the petitioner is allowed. 9.
Accordingly, I direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. 10.
