Chauhan, learned DAG with Mr. Vikash Uniyal, learned Brief Holder, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Mohd Amir S/o Shri Mohd Arif, who has been accused in FIR No.355 of 2025, under Sections 8/21/29/60 of the NDPS, Act at Police Station Haldwani, District Nainital. 4. Learned counsel for the Applicant submits that the Applicant has falsely been implicated in the present matter and he is languishing in jail since 04.04.2026. She further submits that the co-accused has been enlarged on bail by this Court in BA 1st No.2095 of 2025, vide order dated 15.11.2025 and it is a case of parity. She further submits that the contraband recovered is below commercial quantity. 5. Learned State Counsel has vehemently opposed the bail application of the Applicant. 6. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 7. Accordingly, bail application is allowed. It is directed that the Applicant - Mohd Amir S/o Shri Mohd Arif, who has been accused in FIR No.355 of 2025, under Sections 8/21/29/60 of the NDPS, Act at Police Station Haldwani, District Nainital, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
