Accused in Crime No.209/2026 registered by the Kolar Rural Police Station, Kolar District, for the offences punishable under Sections 281, 105 and 324(5) of BNS, 2023, and Sections 181(3) and 185 of the India Motor Vehicles Act, 1988, is before this Court in this petition filed under Section 483 of the BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.209/2026 was registered by the Kolar Rural Police Station, Kolar District, for the aforesaid offences against the petitioner based on the first information dated 24.05.2026 received from Shivanna, father of the deceased boy Likith Gowda. During the course of investigation of the case, the petitioner was arrested on 24.05.2026 and remanded to judicial custody. His bail application filed before the - 3 - HC-KAR CNR: KAHC010484322026 NC: 2026:KHC:44610 CRL.P No. 10480 of 2026 jurisdictional Sessions Court in Crl.Misc.No.565/2026 was rejected on 02.07.2026. Therefore, he is before this Court. 4. In the first information dated 24.05.2026, it is mentioned that on the said date, the first informant and his son Likith Gowda were travelling in their two wheeler bearing registration No.KA-07-Y-7106. When they reached Maderahalli on NH-75, Kolar-Bangalore Highway, at about 1.20 p.m., the Eicher Lorry bearing registration No.AP-39-WB-0219, which was driven in a rash and negligent manner by its driver, dashed against the road divider in the Highway and thereafter, crossed to the other side of the road and dashed against the vehicles which were moving in the Highway. In the said accident, Likith Gowda son of the first informant, who had sustained injuries, subsequently died. Several other vehicles were damaged and persons were injured. It is under these circumstances, FIR came to be registered against the petitioner, who was the driver of the offending Eicher lorry. 5. The petitioner is in custody in the present case from 24.05.2026 onwards. Investigation of the case is completed - 4 - HC-KAR CNR: KAHC010484322026 NC: 2026:KHC:44610 CRL.P No. 10480 of 2026 and charge sheet has been filed. Maximum punishment for the alleged offence is imprisonment for a period of 10 years. 6. Considering the nature of allegations against the petitioner and having regard to the aforesaid aspect of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. 7. Accordingly, the following: ORDER The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.209/2026 registered by the Kolar Rural Police Station, Kolar District, for the offences punishable under Sections 281, 105 and 324(5) of BNS, 2023, and Sections 181(3) and 185 of the India Motor Vehicles Act, 1988, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR CNR: KAHC010484322026 NC: 2026:KHC:44610 CRL.P No. 10480 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
