Accused Nos.1, 3 and 4 in Crime No.136/2026 registered by Magadi Road Police Station, Bengaluru, for the offences punishable under Sections 109, 115(2), 352 read with Section 3(5) of BNS, 2023, are before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.136/2026 was registered by Magadi Road Police Station, Bengaluru, against the petitioners and another based on the first information dated 02.06.2026 received from Anupam Gogoi, who is one of the injured victims in the present - 3 - HC-KAR CNR: KAHC010506192026 NC: 2026:KHC:45028 CRL.P No. 11047 of 2026 case. During the course of investigation, petitioners were arrested on 03.06.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5885/2026 was rejected on 13.07.2026. Therefore, they are before this Court. 4. Perusal of the material on record would go to show that accused in the present case and the victims had fought against each other on 02.06.2026 on the issue of collecting water from a tap in their building. In respect of the said incident that had taken place on 02.06.2026, there is a case and counter case registered in Crime No.136/2026 and Crime No.135/2026 by the very same Police Station. It is brought to the notice of this Court that the alleged victims have suffered only simple injuries in the incident in question. It is also brought to the notice of this Court that accused in Crime No.135/2026 have been granted bail. Under the circumstances, the following order:- 5. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.136/2026 registered by Magadi Road Police Station, Bengaluru, for the offences punishable - 4 - HC-KAR CNR: KAHC010506192026 NC: 2026:KHC:45028 CRL.P No. 11047 of 2026 under Sections 109, 115(2), 352 read with Section 3(5) of BNS, 2023, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE DN List No.: 1 Sl No.: 94
