This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for direction upon the learned Civil Judge (Senior Division), 2nd Court at Barasat, North 24 Paragans, to dispose of the Title Suit No. 454 of 2020, expeditiously. The learned advocate appearing for the petitioners submits that the application filed by the petitioners sometime in the month of October 2023 praying for direction upon the defendants/opposite parties for payment of occupational charges filed is still pending. He submits that the next date fixed for hearing of this application is 3rd December, 2026 and for filing of any written objection in the meantime. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 2nd Court at Barasat, North 24 Parganas, to dispose of the petition for payment for occupational charges on the next date i.e. 3rd December, 2026 and to make an
2 endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. It is however, made clear that in the event the written objection to this application is not filed on or before the next date of hearing, the defendants/opposite parties shall not be allowed to file written objection thereafter and the application shall be decided without any written objection being filed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisites formalities.
