Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 7 months and there has been no progress in the trial of the case and only two witnesses, till date, have been examined and prosecution has relied upon 13 witnesses in order to prove its case. Learned advocate appearing for the de facto complainant opposes the prayer for bail and submits that from the prosecution case, it appears that petitioner is the stepfather. Learned advocate appearing for the State has produced the case diary which includes the statement of the victim recorded under Section 183 of the BNSS as well as the medico-legal examination report. On an assessment of the same along with the evidence of the victim, I am of the opinion that accusations do support the prosecution case. As
2 such, I am not inclined to release the petitioner on bail. At this stage, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1658 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
