JUSTICE M.NAGAPRASANNA ORAL ORDER Heard Sri Rakesh M.T., learned counsel appearing for the petitioners, Smt. Waheeda M.M., learned High Court Government Pleader appearing for respondent No.1, Sri. Shashank D.V., learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR CNR: KAHC010524482026 NC: 2026:KHC:44186 WP No. 24081 of 2026 2. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows: "JOINT AFFIDAVIT " We. (1). SRI. HARSHAVARDHANA C.S, S/o Late Shivanna, Aged about 32 ears, No-67. Channadevi Agrahara, Kadanur, Doddaballapura Taluk, Bangalore Jural-561204 (2). SMT. LAKSHMAMMA, W/o Late Shivanna, Aged about 1 years, No-67 Channadevi Agrahara, Kadanur, Doddaballapura Taluk. Bangalore Rural-561204. (3). SMT. BHAGYAMMA, W/o Nagaraj, Aged about 10 years, R/at Varadhanayakanahalli Village. Thyamagondlu Hobli, Nelamangala Taluk, Bengaluru Rural District-562123, (4). SMT. PAVITHRA V.N. W/o Harshavardhana C.S, Aged about 25 years, No-67, Channadevi Agrahara, Kadanur, Doddaballapura Taluk, Bangalore Rural-561204, do hereby solemnly affirm and state on oath as follows: 1. We are the Petitioners and the Respondent No.2 & 3 in the above case and we are well conversant with facts and circumstance of the case. 2. We state that the Respondent No-2/De-facto Complainant had lodged a complaint before the Women Police Station, Doddaballapura Sub-Division, Bangalore Rural District against the petitioners herein, which was registered as Crime No: 167/2025, now registered as C.C No: 7139/2025 for the alleged commission of offences which are made penal under Sections 85, 351(2), 3(5) of Bharathiya Nyaya Sanhita, 2023 ("BNS"), pending adjudication before the Addl. Civil Judge & JMFC Doddaballapura at Bengaluru Rural District. 3. We state that the dispute arising out of Crime No: 167/2025, which is now registered as C.C No: 7139/2025 - 4 - HC-KAR CNR: KAHC010524482026 NC: 2026:KHC:44186 WP No. 24081 of 2026 has been amicably settled between us with the intervention of elders and family members. 4. We state that there are no disputes between the Petitioner No-1 and the Respondent No-3/victim and they are happily leading their life and this Criminal Prosecution initiated by the respondent No-3 is clearly because of misunderstanding and continuation of this criminal proceedings is causing disturbances in our life and the Petitioners have no role to play as alleged by the Respondent No.2. 5. We state that the settlement has been arrived at voluntarily, without any force, pressure or coercion from any anyone. We jointly stat that the continuation of the criminal proceedings would only result in unnecessary hardship and would not serve the ends of justice. Hence, we jointly pray that this Hon'ble Court be pleased to permit compounding of offence and quash the criminal proceedings in the interest of justice. 6. Hence, it is humbly prayed to consider the joint affidavit and permit us to compound the offence by allowing the annexed application and consequently, quash the criminal proceedings in CC No: 7139/2025 arising out of FIR in Crime No: 167/2025 for offences punishable under Sections 85, 351(2), 3(5) of Bharathiya Nyaya Sanhita, 2023 ("BNS"), against the Petitioners herein pending adjudication before the Addl. Civil Judge & JMFC, Doddaballapura at Bengaluru Rural District to meet the ends of justice. 7. That if this application is not allowed, the Petitioners and the Victim girl /Respondent No-3, will be put to untold hardship, injustice, misery and loss and on the other hand no much hardship will be caused to the other side. WHEREFORE, the Petitioners and Respondent No. 2 & 3 prays this Hon'ble Court to quash the above proceedings in CC No: 7139/2025 against the Petitioners herein pending adjudication before the Addl. Civil Judge & JMFC, Doddaballapura at Bengaluru Rural District, in view of the amicable settlement arrived between, by allowing the application, in the interest of justice and equity." - 5 - HC-KAR CNR: KAHC010524482026 NC: 2026:KHC:44186 WP No. 24081 of 2026 3. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 4. For the aforesaid reasons, the following: ORDER (i) Criminal Petition stands disposed. (ii) Proceedings pending in C.C. NO.7139/2025 pending on the file of THE ADDL.
