PUBLIC PROSECUTOR The Court made the following: 3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CRIMINAL PETITION NO: 5029/2026 ORDER: Instant Criminal Petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhitha, 2023, has been filed on behalf of the petitioner herein/Accused to extend the time for compliance of the condition imposed in the order dated 26.03.2026 in Crl.M.P.No.23 of 2026 in Crl.A.No.83 of 2026, on the file of XII Additional District & Sessions Judge at Visakhapatnam. 2. Heard. Perused the entire available material on record. 3. Learned counsel for the petitioner, after arguing for some time, confined his argument to the extent of enlargement of time to deposit 5% of the fine amount imposed by the learned Sessions Judge in the order dated 26.03.2026, for further period of two (02) weeks, by citing health grounds which affected the petitioner’s financial capacity. 4. On the other hand, Sri Neelothpal Ganji, learned Assistant Public Prosecutor, did not oppose the same. 5. Considering the submissions made, more particularly, taking note of the petitioner’s financial inability caused due to ill health, the criminal petition is disposed of granting two (02) weeks’ time from today, to the petitioner, so as to comply with the order dated 26.03.2026 in Crl.M.P.No.23 of 2026 in 4 Crl.A.No.83 of 2026, on the file of XII Additional District & Sessions Judge at Visakhapatnam. 6. Till such time, it is made clear that respondent/police shall not take any coercive steps against the petitioner herein. 7. There shall be no order as to costs.
