1. By the present writ petition, the petitioner seeks a direction to the respondent authorities to issue an appointment order in favour of the petitioner for the post of Transport Sub-Inspector (Technical) under the ST Category and further seeks a direction to consider and decide his pending representations dated 14.02.2026 and 20.07.2026 (Annexures P/9 & P/12 respectively).

(a) Learned counsel appearing for the petitioner submits that pursuant to the advertisement dated 13.04.2022 issued by the Chhattisgarh Public Service Commission for recruitment to the post of Transport Sub-Inspector (Technical), the petitioner participated in the selection process and was placed at Serial No.1 in the ST waiting list. He further submits that the petitioner had earlier approached this Court by filing WPS No.5206/2023, challenging the appointment order dated 20.12.2022, whereby respondents No.4 and 5 therein were appointed to the post of Transport Sub-Inspector. However, the said writ petition was
disposed of with liberty to the petitioner to avail his remedy before the State Government insofar as his claim for appointment to the post of Transport Sub-Inspector was concerned. Learned counsel submits that thereafter the candidates initially selected against the said posts were found not to have fulfilled the mandatory physical eligibility prescribed under the applicable Rules and their appointments were consequently cancelled by the State
3 Government vide order dated 19.06.2024. He further submits that the said cancellation was challenged by the concerned candidates in WPS No.3586/2024 and WPS No.3602/2024, which were dismissed vide common order dated 28.01.2026, and the challenge was further carried in Writ Appeal No.263/2026, which was also dismissed vide order dated 02.04.2026. (b) Learned counsel further submits that, thereafter, the petitioner submitted representations dated 14.02.2026 (Annexure P/9) and reminder representation dated 20.07.2026 (Annexure P/12) seeking appointment against the resultant vacancy, but no decision has been taken by the respondent authorities till date. He, therefore, prays that the present petition may be disposed of with a direction to the respondent authorities to consider and decide the petitioner’s pending representations in accordance with law.
3. Learned State counsel submits that if the representations submitted by the petitioner are still pending consideration, the same shall be considered and decided in accordance with law, within the stipulated period.
4. I have heard learned counsel for the parties and perused the pleadings as well as the documents appended with the writ petition.
5. Considering the limited prayer made by learned counsel for the petitioner and also taking into account the submission made by
4 learned State counsel, this writ petition is disposed of with a direction to the respondent authorities to consider and decide the pending representations dated 14.02.2026 and 20.07.2026 (Annexures P/9 & P/12 respectively) submitted by the petitioner and pass an appropriate order, in accordance with law, preferably within a period of 50 days from the date of receipt of a copy of this
order.
6. With the aforesaid direction, the writ petition is disposed of. Sd/-
