Case No. 1283 of 2019, arising out of Tarakeshwar Police Station Case No. 216 of 2019, dated October 26, 2019, under Sections 341/326/307/506/34 of the Indian Penal Code, 1860, read with Sections 3/4 of the Explosive Substances Act, 1908, culminating in the submission of Charge Sheet No. 152 of 2020, dated November 18, 2020, under Sections 341/326/307/506/34 of the Indian Penal Code, 1860. The proceeding is presently pending before the learned Additional Chief Judicial Magistrate, Hooghly. Learned advocate appearing for the petitioner submits that, although the charge-sheet in the present case was filed on November 18, 2020, the proceeding has not progressed any further due to the absence of three accused persons out of the total fifteen accused persons. It appears that the learned Magistrate in the Court below has fixed November 19, 2026, for service of the return of summons and for appearance of the absconding accused persons. In view of the aforesaid, I dispose of the present revisional application with the following directions. If the absconding accused persons do not appear on the next date of hearing, the learned Magistrate shall issue warrants of arrest against them and take necessary steps for execution thereof in accordance with law. In the event of the continued absence of the said three accused persons, the learned Public Prosecutor before the Court below shall be at liberty to file an application seeking splitting up of the trial. If such an application is filed, the learned Magistrate shall consider the same in accordance with law and take necessary steps for splitting up of the trial. Accordingly, C.R.R. 3329 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
