HON'BLE MR. JUSTICE SAMEER JAIN
Order 16/03/2026 Present application is moved for recalling of the order dated 23.09.2025, whereby it was directed to the Registrar (Judicial) to initiate recovery measures in terms of the order dated 25.08.2025 against the petitioner in S. B. Civil Writ Petition No. 10379/2025.
Learned counsel for the applicant submits that vide order dated 25.08.2025, this Court passed a specific order that if demand draft worth Rs. 1 Lac is not deposited with the Registrar General, Rajasthan High Court, within a specified period, the writ petition(s) filed will be dismissed automatically. It is further submitted that the applicant (petitioner therein) treated the order
[2026:RJ-JP:11083] (2 of 2) [WMAP-24/2026] dated 25.08.2025 as final and self-executing, eventually resulting in dismissal of the writ petitions. It is next submitted that despite the above directions, the matter was listed before this Court and order dated 23.09.2025 came to be passed with categorical directions to the Registrar (Judicial), as the said cost had not been deposited, recovery should be initiated qua the petitioner(s) therein in terms of the
order dated 25.08.2025. Moreover, it is submitted that the order dated 23.09.2025 travels beyond the operative intent of the order dated 25.08.2025 as the Court itself directed that the petition(s) shall stand dismissed automatically upon non-compliance, the matter stood closed by its own, leaving no occasion for further judicial direction.
Learned counsel further submits that imposition of cost of Rs.1 Lac is not in accordance with the directions spelled out in the
order dated 25.08.2025 and that the dismissal of the writ petition(s) on account of non-compliance has not been put to challenge. In light of the aforesaid facts and circumstances, though the petition(s) is/are dismissed upon non-compliance of the directions spelled out in the order dated 25.08.2025, this Court is vacating the cost of Rs. 1 Lac as imposed vide order dated 23.09.2025. Accordingly, present application is disposed of.
