G.P. for Revenue The Court made the following: 2 BSB,J W.P.No.16599 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…to issue writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondent No. 3 in not passing any order on the appeal of the petitioner vide Rc. No. C3/495/2025 in respect of the land in Sy. No. 245 to an extent of Ac. 2.88 cents, Sy. No. 254 an extent of Ac. 4.59 cents and Sy. No. 246 an extent of Ac. 0.96 cents of Mudigallu village Polam, Kalyandurg Mandal, Anantapur District, as illegal, arbitrary and in violation of principles of natural justice and in violation of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondent No. 3 to pass appropriate orders on the appeal of the petitioner and to pass…” 2. Sri G. Divyatheja, learned Assistant Government Pleader for Revenue placed on record a copy of written instructions of the respondent No. 3, vide Rc. No. C3/495/2025, dated 23.06.2026 wherein it is stated as follows: “…In this connection, it is submitted that during the pendency of the appeal proceedings, the 3rd respondent in the ROR Appeal was expired. However, the appellant/s have not filed any petition to bring the legal representatives of the deceased respondent on record. In the absence of impleadment of the legal heirs, the appeal cannot be adjudicated finally as any order passed would affect the rights of necessary parties who are not before the authority and would be contrary to the principles of natural justice. 3 BSB,J W.P.No.16599 of 2026 It is further submitted that the delay in disposal of the appeal is neither willful nor deliberate. The appeal could not be taken up for final orders solely due to the non-filing of a legal representative petition by the appellant for bringing the legal heirs of the deceased respondent on record…” 3. Heard learned counsel for the petitioner. 4. Considering the submissions made on both the sides and the written instructions, the writ petition is disposed of directing the petitioner to immediately take appropriate steps for bringing the legal representatives of the deceased respondent on record to enable the appellate authority to dispose of the appeal expeditiously.
