ORAL ORDER
Learned counsel for the petitioner filed a memo dated 24.08.2026 seeking to convert the present revision into criminal appeal. The contents of the memo is as under:- MEMO The petitioner in revision submits that, in view of the statutory remedy available under Section 14A of the Scheduled Castes and Scheduled Tribes(Prevention of Atrocities) Act, 1989, the petitioner prays that the Hon'ble Court may be pleased to permit the petitioner to convert the above revision to Appeal under Section 14A of the Scheduled Castes and Scheduled Tribes(Prevention of Atrocities) Ac, 1989, in the interest of justice and equity.
2. Perused the revision petition. The petitioners have filed this petition under Section 438 r/w 442 of BNSS, 2023 to set-

aside the order dated 26.03.2026 passed on application under Section 227 of Cr.P.C. by the Special Court. The perusal of the
order dated 26.03.2026 goes to show that it is not interlocutory in nature. Thus, if it is not interlocutory order passed by the Special Judge under the Scheduled Castes and Scheduled Tribes(Prevention of Atrocities) Act, 1989(for short 'SC/St Act'), it is appealable as per Section 14A of the SC/ST Act. The order rejecting the application for discharge is not interlocutory order and therefore, the revision petition is not maintainable.
Accordingly, the learned counsel for the petitioner is permitted to convert the present revision petition into criminal appeal. Hence, the revision petition is disposed of for statistical purpose. Registry shall return the certified copy of the impugned
order to the learned counsel for the petitioner.
