This is the third bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 06/2026 registered at Police Station Bilaigarh, District Sarangarh-Bilaigarh (C.G.), for the offence punishable under Sections 109(1), 118(1), 126(2), 191(2), 191(3), 190 and 61(2) of BNS. 2. Earlier, first bail application i.e. MCRC No. 3793 of 2026 was rejected on merits vide order dated 27.04.2026 and repeat application i.e. MCRC No. 6407 of 2026 was rejected by detailed order vide order dated 20.07.2026. The applicant is in jail since 08.01.2026 and till date single witness has not been examined by the prosecution. 4. The prosecution story, in short, is that the complainant, Puleshwar Verma, aged about 28 years, lodged a written report on 03.01.2026, alleging that on the same day, while he was returning to his home along with Ramvilas and Pramod Sahu, the present applicant stopped him near the house of Paras Yadav and assaulted him with a knife. Further, while the complainant was proceeding to the police station along with his father and uncle, near the house of Sammelal Sahu, the present applicant along with other co-accused, assaulted them with club and prevented them from lodging the report. On such a complaint, above stated offences were registered against eight persons including present applicant. 5. Mr. Sunil Sahu, learned counsel appearing for the applicant would submit that there is delay in trial. He would further contend that an application for cancellation of bail has been moved by the complainant before the learned trial Court and matter is being adjourned on said application. He would submit that the bail application of the present applicant may be allowed on ground of parity and delay in trial. 6. On the other hand, learned counsel appearing for the State would oppose. Mr. Dharmesh Shrivastava, Dy. Advocate General would submit that the present applicant is a person, who inflicted fatal knife blow over vital parts of the injured and the weapon was seized from his possession. He would submit that the merit of the case has been considered in two earlier orders passed in MCRC No. 3793 of 2026 and MCRC No. 6407 of 2026. He would contend 3 that within one month from date of rejection of earlier bail application, the instant application has been moved for grant of regular bail, whereas, these grounds were available with the applicant on 20.07.2026 also. He would submit that this application deserves to be rejected. 7. I have heard learned counsel appearing for the parties and perused the case diary. 8. Having considered the fact that the applicant is the person who inflicted three knife injuries over vital parts of body of the injured. Further, two applications were rejected on merits vide order dated 27.04.2026 and 20.07.2026. The applicant is in jail from 08.01.2026, though there is no progress in the trial but on that ground alone the applicant cannot be released on bail. With regard to ground of parity, the allegations against the present applicant and the co-accused, who have been enlarged on bail are different. 9.
