1. Parties are present through their respective Counsel. 2. The present petitioners are the parents of the principal accused person. The victim died by poisoning. As per the allegations made in the FIR, the principal accused was the husband of the victim, i.e., son of the present petitioners. The present petitioners and the principal accused allegedly murdered the victim. 3. Learned Counsel for the State has relied upon the statement of the witnesses recorded under
2 Section 180 of the BNSS. He also referred to the inquest report. 4. According to the learned Counsel for the State, the inquest report contains certain injuries on the neck of the victim which, according to him, are signs of forceful administering of poison. 5. Learned Counsel for the petitioners relies upon the post mortem report where autopsy surgeon did not find any injury on the person of the victim. 6. I have gone through the statement of the witnesses recorded under Section 180 of BNSS. Such statement demonstrates that the present petitioners used to assault the victim. 7. The material in the Case Diary goes to disclose that the victim was married to the principal accused, which was an outcome of love affairs in between them. There are allegations that the petitioners also, used to assault the victim. The principal accused has been arrested and is in custody. Charge sheet has been submitted in the instant case. 8. In such circumstances considering the nature of allegations and materials in the Case Diary and also taking into account that the
3 investigation of the case is already over, the prayer for anticipatory bail of the petitioners, is allowed. 9. In the event of arrest, the petitioners, namely, Satyendranath Kisku & Gita Kisku @ Purnima Kisku shall be released on bail upon furnishing a bond of Rs.
10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, 1973 corresponding to Section 482 (2) of the BNSS, 2023 and on further conditions that the petitioners shall co-operate with the investigation and shall not threaten or intimidate the witnesses. The petitioners shall meet the I.O. once a week till submission of report in final form. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date. 10. The application for anticipatory bail being CRM (A) 2541 of 2026, is thus, disposed of. 4
