Case No. 232 of 2026 dated 15.03.2026 under Sections 115(2)/ 117(2) / 118(2) / 126(2) / 303(2) / 324(4) / 351(2) / 76 / 3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of: Sk. Mahim ….Petitioner. Mr. Souvik Ganguly …for the petitioner. Mr. Pradip Banerjee Mr. Rohan Bavishi …..for the State. 1. Upon hearing the rival contentions and on perusal of the materials in the case diary, it appears that the petitioner is alleged to have assaulted the victim when a protest was raised by the victim while the petitioner and others were abusing them. It has been submitted by the learned advocate for the petitioner that the petitioner has been falsely implicated in this case due to disputes over the construction of a club house and obstruction of the road. The petitioner and the de facto complainant are neighbours. It has also submitted by the learned advocate for the petitioner that all other accused persons except the present petitioner have been granted anticipatory bail by the learned jurisdictional Court. Charge sheet has been submitted. 2. Learned advocate for the State relies upon the injury report. The injuries have been classified as simple in such injury report. 2 3. Considering the aforesaid facts and circumstances of the case, the prayer for anticipatory bail of the petitioner is allowed. 4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioner shall surrender before the learned jurisdictional Court within four weeks from this date and pray for bail and shall regularly attend the jurisdictional Court and shall not threaten or intimidate witnesses. 5. CRM (A) 2537 of 2026 is disposed of. 6. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Md. Shabbar Rashidi, J.)
