1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. The petitioner is a mother and she alleges that she is being tortured by the private respondents, who are her son and daughter-in-law, for a substantial span of time,
3. The learned counsel for the petitioner today handed over an order dated July 30, 2025 passed by the Sub- Divisional Officer, Sadar, Howrah in connection with a case bearing No. 56 of 2025-26 initiated under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 [hereafter ‘the said Act of 2007’].
4. The order dated July 30, 2025 passed by the Sub- Divisional Officer, Sadar, Howrah is taken on record.
5. The Sub-Divisional Officer, Sadar, Howrah having considered the submissions made by the petitioner, inter alia, passed the following order:
“Upon hearing the submissions of both sides, this Maintenance Tribunal is of the opinion that –
1) The petitioner, Sindhurani Pradhan, is not in need, at this moment, for any maintenance related
Order. 2) The petitioner wants the accused person vacate the said house immediately. However, this Tribunal emphasises that this Tribunal has no jurisdiction to evict any person from the house. The petitioner is advised to approach any suitable forum or Authority to seek such remedy if she desires so. The Officer in Charge of Sankrail Police Station is
directed to ensure the maintenance of peace and tranquility between the petitioner and the accused persons in the house under question. Let copies of this Order be circulated to all concerned.”
6. The petitioner, being aggrieved by the order dated July 30, 2025, preferred an appeal before the appellate authority under the said Act of 2007 and this Court has been informed that the said appeal is pending for final adjudication.
7. At this stage, no useful purpose will be served by keeping the matter pending. The petitioner’s appeal is pending before the appellate authority under the said Act of 2007. The petitioner is at liberty to take necessary legal points before such authority as is permissible in law.
8. In view of the above, this writ petition stands disposed of.
9. There shall be no order as to costs.
