Order on Board 22/09
/2026
1. The petitioner who is working as Court Manager has filed this petition assailing order dated 25.08.2026 by which he has been transferred from District Court, Mungeli to District Court, Janjgir-Champa.
2.
Learned counsel for the petitioner would submit that the petitioner’s wife is working as Assistant Professor and posted at Government Mata Shabari Naveen Girls College, Bilaspur. He would further submit that he has two sons and he has been transferred to Janjgir-Champa which is away from his present place of posting and the same will adversely affect his social responsibility and would pray for quashing of the impugned transfer order dated 25.08.2026. 3. On the other hand, learned counsel for respondents No. 1, 2 & 3 opposing the submission made by learned counsel for the petitioner ARUN KUMAR DEWANGAN Digitally signed by ARUN KUMAR DEWANGAN Date: 2026.09.22 17:14:43 +0530
would submit that the petitioner has been transferred from Mungeli to Janjgir-Champa which is not far from Bilaspur where his wife is working. He would further submit that no employee can insist for a particular place of posting of his/her entire service period, as such, the transfer order is just and proper and does not warrant any interference by this Court and would pray for dismissal of the writ petition. 4. I have heard learned counsel for the parties and perused the documents placed on record with utmost satisfaction. 5. Considering the well settled legal position that no employee can insist for a particular place of posting of his/her entire service period, I am not inclined to entertain the instant writ petition challenging impugned transfer order dated 25.08.2026. 6. It is well settled legal position that no employee can insist to remain posted in particular place of posting of his entire service period. Hon'ble the Supreme Court in SK Nausad Rahaman & others Vs. Union of India & others [(2022) 12 SCC 1], has held at paragraph 24 as under:-
“24. First and foremost, transfer in an All India Service is an incident of service. Whether, and if so where, an employee should be posted are matters which are governed by the exigencies of service. An employee has no fundamental right or, for that matter, a vested right to claim a transfer or posting of their choice.”
7.
Considering the fact that the petitioner has been transferred from Mungeli to Janjgir and distance between Mungeli and Janjgir is not far which will create hardship to maintain social life and also considering the law laid down by Hon'ble the Supreme Court in SK Nausad Rahaman (Supra), this petition sans merit and is liable to be dismissed. 8. Accordingly, the instant petition is dismissed. Sd/- (Narendra Kumar Vyas) Judge Arun
