Heard Mr. Akhand Pratap, learned counsel for the petitioners. Also heard Mr. S. S. Baghel, learned Govt. Advocate, appearing for State- Respondent No.1, Mr. Sangeet Kumar Kushwaha, learned counsel for the Respondent No.2. 2. The present petition has been filed by the petitioners seeking the following relief(s): “1. Quash and set aside Charge-Sheet bearing No. 339 of 2023, submitted by Police Station Azad Chowk,, District Raipur in FIR No. 168 of 2022 registered under Sections 120B & 420 of the Indian Penal Code, 1860, and all consequential 3 proceedings arising therefrom on the ground of compromise. 2. Quash and set aside the order dated 22.12.2023 passed by the learned Judicial Magistrate First Class Raipur, whereby cognizance was taken against the petitioners for the offences under Sections 120B & 420 of the Indian Penal Code, 1860, 3. Quash and set aside the order dated 11.02.2026 passed in Criminal Case No. 22561 of 2023, passed by the learned Judicial Magistrate First Class Raipur, District Raipurwhereby charges under Sections 1208 & 420 of the Indian Penal Code, 1860 have been framed against the petitioners. 4. Quash the entire proceedings of Criminal Case No. 22561 of 2023, for the offence punishable under Sections 120B & 420 of the Indian Penal Code, 1860 pending before learned Judicial Magistrate First Class Raipur Raipur Raipur as continuation of the said trial would amount to abuse of the process of Court in light of the amicable settlement between the parties. 5. Pass such further or other orders as this Hon'ble Court may deem fit and proper in the interest of 4 justice.” 3. It transpires from the document annexed with the petition Annexure (P/5) is coloured photocopy of the original compromise deed dated 09-12-2025 between the parties, and a pointed query being made from the counsel for the petitioners as to why he has filed such documents and as to where the original documents are, he states that he would file the original copies of the compromise/ settlement agreement dated 09.12.2025 and prays that the present petition may be dismissed as withdrawn with liberty to file it afresh. 4. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs.5,000/- by each of the petitioners (total Rs. 25,000/-) as cost in the Registry of this Court and the Respondent No. 2 shall also deposit Rs. 10,000/- as cost in the Registry of this Court for filing the petition in a most casual manner without annexing the original copy of the compromise/ settlement agreement dated 09.12.2025, and wasting the precious time of this Court. The said amount of Rs. 35,000/- shall be transmitted to Government Special School for Intellectual Retardation, Rajnandgaon, Dist- Rajnandgaon (C.G.). 5.
