ORAL ORDER
1. Accused in SC No.1613/2024 pending before the Court of LXI Addl. City Civil and Sessions Judge, Bengaluru, arising out of Crime No.256/2024 registered by Banashankari Police Station, Bengaluru, for the offence punishable under Section 109(1) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.256/2024 was registered by Banashankari Police Station, Bengaluru, for the aforesaid offence against the petitioner herein based on the first information dated 17.09.2024 received from Hemanth, who is the injured victim in the present case. During the course of investigation, petitioner was arrested on 17.09.2024 and remanded to judicial custody. After completing investigation, charge sheet is filed against him for the aforesaid offence. His

bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.6158/2026 was rejected on 04.07.2026. Therefore, he is before this Court. 4. In the first information dated 17.09.2024, it is stated that on 16.09.2024 at about 11.20 p.m. when the first informant was returning home in his bike from his office, he found people gathered on the road. Therefore, he got down from his bike and went towards the said place. Petitioner, who saw him allegedly approached him and assaulted him with a razor causing injuries. It is under these circumstances, FIR was registered against the petitioner. Investigation of the case is completed and charge sheet is filed. Injured victim has suffered only simple injuries in the aforesaid incident. Petitioner is in custody for the last nearly two years. Trial in the case is yet to commence. In the other criminal cases registered against the petitioner, he is said to have been enlarged on bail. Insofar as the present case is considered, considering the nature of allegations found against the petitioner, who is in custody for nearly two years, his prayer for grant of regular bail needs to

be answered affirmatively, subject to appropriate conditions. Accordingly, the following order:-
5. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.1613/2024 pending before the Court of LXI Addl.
City Civil and Sessions Judge, Bengaluru, arising out of Crime No.256/2024 registered by Banashankari Police Station, Bengaluru, for the offence punishable under Section 109(1) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
