Learned advocate appearing for the petitioners submits that petitioners have been foisted with the present criminal case because of previous disputes. Learned advocate appearing for the de facto complainant insists on the injuries which have been inflicted upon Sk. Ali Md. Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail and produces the case diary. I have taken into account the injury reports which are available as well as the statement of the injured. Having considered the same, I am of the opinion that Sk. Badsha 2 inflicted the vital blow which resulted in injury sustained by Sk. Ali Md. So far as the present petitioners are concerned there are accusations against them of fists, blows and kicks being inflicted and assisting the principal accused. Having considered the overall circumstances of the case, I am of the opinion that since the present petitioners are all ladies their custodial detention in connection with the instant case is unwarranted. As such, the prayer for anticipatory bail of the petitioners is allowed. Accordingly, in the event of arrest, the petitioners viz., 1. Sahajadi Bibi, 2. Juli Bibi and 3. Ashmin @ Asmin Bibi shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioners shall make themselves available before the Investigating Officer of the case as and when called for by the Investigating Officer of the case for the sake of investigation. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for anticipatory bail, being CRM (A) 2597 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
