Dr. Pradip Banerjee Ms. Shalu Gupta ...for the State. 1. Learned counsel for the State submits a report of the Investigating Officer of the Bhowanipore P.S. Case No. 54 dated March 20, 2021 under Sections 120B/406/420 of the IPC. Let the said report be taken on record. 2. On perusal of the said report, it appears that the two of the accused namely, Greaves Cotton Limited, the petitioner herein and Sanjay Shah, have been discharged from the aforesaid Criminal Case for want of evidence. 3. Learned Counsel for the State further submits that in view of such discharge of the petitioner, nothing remains to be argued and/or decided in the matter. 4. The learned Counsel for the petitioner supports the submission of the State. 5. In light of the joint submission of the parties as well as taking into consideration the aforesaid report relating to the discharge of the petitioner from the connected criminal case, I am of the view that the relief(s) prayed for by the petitioner 2 have become infructuous, as such the present criminal revisional application is liable to be dismissed. 6. Accordingly, CRR 2098 of 2023 is dismissed as infructuous. There shall be no order as to costs. 7. Leave is granted to the parties to approach this Court in case a situation so arises. 8. Interim order(s), if there be any, stand(s) vacated. 9. Urgent photostat copies of the order, if applied for, be supplied to parties, upon compliance with all prerequisite formalities.
