D/L261 25.08.2026 Bpg. C.R.M. (M) 1404 of 2026 In Re: An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Raghunathganj Police Station Case No.649 of 2025 dated 18.05.2025 under Sections 329(4)/117(2)/118(1)/118(2)/109(1)/3(5) of BNS, 2023 adding Section 103(1) of BNS; Pintu Mondal Versus The State of West Bengal Mr. Kusal Kumar Mukherjee Mr. Arijit Bose. ...for the petitioner. Mr. Goutam Dey Mr. Neel Chakraborty. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 4 months. There is no possibility of the trial commencing very soon and the petitioner himself has sustained injury. As such, petitioner may be granted bail. State has produced the case diary and drawn the attention of the Court to the statement of the eyewitnesses. It has also been contended that the offending weapon has been recovered pursuant to the leading statement of the present petitioner. I have taken into account the materials appearing in the case diary and on an assessment of the same, I am of the view that this is not a fit case for granting bail. As such, the prayer for bail in 2 CRM(M)1404 of 2026 is dismissed at this stage. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
