ORDER The present Criminal Miscellaneous Petition has been filed seeking cancellation of the bail granted to the second accused by this Court in Crl.O.P.No.8232 of 2026 dated 02.04.2026. 1/4 https://www.mhc.tn.gov.in/judis

2. The learned counsel for the petitioner would submit that the total quantity of gold jewels alleged to have been stolen is 194 grams. However, while seeking bail, the accused had represented before this Court that the value of the stolen property was only Rs.3,59,000/- and thereby obtained bail. According to the petitioner, the total quantity of the stolen gold jewels is 194 grams and the respondent Police have recovered only 94 grams. It is his contention that had the exact quantity of the stolen jewels been brought to the notice of this Court, bail would not have been granted to the accused. 3. The said contention was stoutly opposed by the learned Government Advocate (Puducherry), and would submit that, as on the date of filing of the bail petition, there was only one victim. He would further submit that the First Information Report itself refers to the value of the gold jewels as Rs.5,59,500/-. Though there is a reference to Rs.3,59,000/-, this Court finds that the FIR discloses the value of the stolen jewels as Rs.5,59,500/-. 4. At this juncture, the learned Government Advocate (Puducherry) would submit that, according to the investigation, the total value of the stolen property is about Rs.32,00,000/- and nearly 75% of the stolen property has already been 2/4 https://www.mhc.tn.gov.in/judis
Crl.O.M.No.8280 of 2026 in Crl.O.P.No.8232 of 2026 recovered. It is further submitted that the final report has also been filed. In such circumstances, merely on the ground relating to the valuation of the stolen articles, the order granting bail cannot be interfered with. Hence, this Court finds no merit in the present petition.
