Mr. Yogesh Pandey, learned D.A.G. for the State of Uttarakhand/respondent Nos.2 to 4. 4. Petitioner has filed the present writ petition on the premise that land comprised in Gata No.68Ka of village Village Vishanpur, Tehsil Kotdwar, Pauri Garhwal, has been acquired by the respondent No.1-NHAI for construction and widening of NH No.119 Kotdwar Bye Pass and the petitioner has not been given any compensation for the said land, on which, according to him, double storey house was existed. 5. This Court vide order dated 18.04.2026 directed learned counsel for respondent No.1-NHAI to take instruction from the Project Director, NHAI about the averment made in present writ petition. 6. Today, learned counsel for respondent No.1-NHAI produced the instruction, which is taken on record. 2026:UHC:3131 7. On the basis of instruction, learned counsel for respondent No.1-NHAI submitted that aforesaid land was a part of the acquisition, but the CALA has passed an award, in which it was found that the said land was a government land, and therefore, no compensation was assessed over the said land. 8. It is further informed by him that the said award passed by CALA can be challenged by the petitioner in appropriate proceedings before the Arbitrator/District Magistrate, Pauri Garhwal. 9. In view of the statement made by learned counsel for respondent No.1-NHAI, the present writ petition is closed. However, it is open to petitioner to challenge the said award before the Arbitrator/District Magistrate, Pauri Garhwal, in appropriate proceedings, if so advised. 10.
