27.08.2026 D/L.25 Court No.42 Saikat Mukherjee CRR/1465/2024 SANJAY BISWAS @ SANJAY KUMAR BISWAS AND ANR. VS STATE OF WEST BENGAL AND ANR. Mr. Ahitagni Dey, Adv. ….For the Petitioners 1. None appears for the opposite parties when the matter is called on for hearing. 2. Learned counsel appearing for the petitioners submits that the challenge in the instant revisional application is directed against the order dated 21st March, 2024, passed in Misc. Case No. 2896 of 2023 by the learned Executive Magistrate, Rampurhat, Birbhum, under Section 144 of the Code of Criminal Procedure. It is pointed out that by sheer efflux of time, the operational lifespan of the impugned preventive order has long since expired, rendering the present challenge entirely infructuous, as orders of this nature are inherently temporary in character. 3. Upon a careful perusal of the materials on record and the impugned order, I find substantial force in the submissions advanced by the learned counsel for the petitioners. Since the statutory duration of the preventive measure has lapsed, keeping this proceeding alive would serve no practical purpose and reduce any further adjudication to a purely academic exercise. 2 4. Consequently, the revisional application, being CRR 1465 of 2024, stands dismissed as infructuous. 5. There shall be no order as to costs. 6. Interim order, if any, stands vacated. 7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all necessary formalities. (UDAY KUMAR, J.)
