Maya Rani Nath Mr. Siva Prasad Ghose ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.), 1st Court at Barasat to dispose of the Title Suit No.380 of 2014 expeditiously. Mr. Ghose, learned advocate appearing for the petitioner submits that in the Final Decree proceeding, the Partition Commissioner has already submitted a report but the Final Decree is yet to be passed. From the order sheets appended to this application, this Court finds that August 28, 2026 has fixed for filing of the written objection to the Partition Commissioner’s report. Mr. Ghose, learned advocate appearing for the petitioner submits that none of the parties have prayed for an opportunity to file the written objection to the said report. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party 2 or the learned advocate representing the opposite party before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 1906 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 1st Court at Barasat to dispose of the Final Decree proceeding in Title Suit No.380 of 2014 as expeditiously as possible but preferably within a period of 6 months from the next date fixed without granting any unnecessary adjournments to either of the parties. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
