27.08.2026 Sl. No.47 Ct. 446/tkm C. R. M. (A) 2179 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bidhannagar South Police Station Case No.163 of 2026 dated 23.06.2026 under sections 302(2)/85 BNS 2023 And In Re: Subhojit Paul … … Petitioner Allowed Mr. Pintu Karar Mr. Dipankar Das … … for the petitioner Mr. Prantik Sarkar … … for the State 1. Learned Advocate for the petitioner submits that, following a dispute in the marital life of the parties, the present case was initiated against the petitioner. There was an altercation between the parties and the allegations of torture are general and omnibus in nature. He submits that subsequently, the petitioner and the de facto complainant have settled the dispute between them out of Court. He submits that they have jointly filed an application seeking mutual divorce. He submits that, taking note of this subsequent development, the petitioner may be granted pre- arrest bail. 2. Learned Advocate for the State produces the case diary, memo of evidence and opposes the prayer for anticipatory bail. 3. Heard the learned Advocates appearing for the respective parties and perused the materials in the case diary. No injury report is available in the case diary. Taking note of the fact that the parties have jointly agreed to dissolve their marital tie and have jointly filed a petition before the competent Court of law seeking mutual 2 divorce, I am of the view that custodial interrogation of the petitioner is not necessary and that the benefit under Section 482 of the BNSS can be extended in favour of the petitioner. 4. Accordingly, I direct that, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the learned ACJM Bidhannagar, North 24 Pgs. and also subject to the conditions as laid down under Section 482(2) of the BNSS, 2023. 5. The application being CRM (A) 2179 of 2026 is disposed of. (Partha Sarathi Chatterjee, J.)
