The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records in relates to the case of the petitioner from the possession of respondents for its kind perusal. 2 10.2 That, this Hon'ble Court may kindly be pleased to quash and set-aside order dated 10.09.2025 (Annexure P/16) wherein appeal of the petitioner has been rejected by the respondents along with decision by the District Rationalization Committee (Annexure P/14) and transfer order dated 04.06.2025 (Annexure P/8). 10.3 That, this Hon'ble Court may kindly further be pleased to direct the respondents to make deputation and posting of the petitioner for one (01) vacant post of Lecturer (Physics) at Swami Atmanand (English/Hindi) School (SAGES) i.e. Govt. Higher Secondary School Kodatarai, Block Pussaur, District Raigarh (C.G.) on the basis of consent of the petitioner. 10.4 That, alternatively, this Hon'ble Court may kindly be pleased to direct the respondents to conduct re- counselling of the petitioner showing the vacant post of Lecturer (Physics) at Govt. Higher Secondary School Sambalpuri, Block Raigarh, District Raigarh (C.G.) which is still lying vacant. 10.5 Any other relief, which this Hon’ble Court may deem fit and proper according to the facts and circumstances of the case along with cost of the petition” 2. Learned counsel for the petitioner submits that in the order dated 10.09.2025 (Annexure P/17), there is mention that the petitioner had not given her consent for her deputation at Swami Atmanand Government English School whereas, petitioner gave written consent which was not considered and therefore, the decision of the Committee at the Divisional Level under the Rationalization Policy, 2025 is erroneous. 3. After arguing for sometime, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition at this stage with liberty to file afresh representation raising all the grounds as raised in this writ petition before the State Level Committee under the Rationalization Policy, 2025 and the concerned Committee be directed to consider and take decision on the representation at the earliest. 4. On the other hand, learned counsel for the Respondents/State submits that in view of the limited prayer made by the counsel for petitioner, he is having no objection. 3 5. I have heard learned counsel for the parties and perused the documents placed on record. 6. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of the petitioner, this writ petition is disposed of at this stage, permitting the petitioner to submit a fresh representation before the State Level Committee constituted by the State Government raising all the grounds as raised in this writ petition and in the event petitioner submits representation, the concerned Committee shall consider and take decision on the representation to be submitted by the petitioner within a period of 04 weeks from the date of submission of representation. 7.
