The petitioner has filed the instant writ petition alleging that pursuant to a complaint lodged by the petitioner, the New Town Police Station had registered New Town Police Station Case No. 119 of 2024 dated 9th May, 2024 for investigation into the offence punishable under Section 341/323/506/509/34 of the Indian Penal Code. The grievance of the petitioner was that the police, while drawing the FIR, did not incorporate all the penal sections under which the investigation ought to have been made. 2. After filing of the writ petition, this Court directed the police to submit a report on the process of the investigation. 3. Today, Ms. Suchitra Sinha Chatterjee, learned advocate appearing for the State files a report before the Court. The report reveals that pursuant to the 2 investigation into the aforesaid case, the Investigating Officer has already submitted a charge-sheet being No. 191 of 2024 dated 31st July, 2024 under Sections 341/323/506/509/354B/34 of the Indian Penal Code against the accused persons, namely, Samrat Chakraborty, Sanjoy Majumder, Bibek nandi and Satadal Chatterjee. It is further submitted that subsequent to submission of the original charge-sheet, a supplementary charge-sheet being No. 96 of 2025 dated 11th May, 2025 was submitted under Sections 341/323/506/509/354B/34 of the Indian Penal Code against the accused persons. The report also reveals that a counter case bearing New Town Police Station Case No. 122 of 2024 dated 12th May, 2024 under Sections 447/341/323/325/506/354/379/34 of the Indian Penal Code has been registered against the accused persons therein. 4. Be that as it may and without commenting upon the merits of the complaint or allegations made by the parties, this Court considers it appropriate to dispose of the instant writ petition reserving the right of the petitioner to approach the Court of appropriate Judicial Magistrate to file appropriate Narazi petition in the event the petitioner is dissatisfied with the manner of investigation in the said case. 5. Accordingly, WPA 15778 of 2024 stands disposed of with the above observations. It is clarified that this Court has not gone into the merits of the allegations or the merits of the investigation conducted by the 3 Investigation Officer and the learned Magistrate shall be free to deal with the application strictly in accordance with law. 6.
