Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 11 months. Both the petitioner and the victim are matured and they are able to understand the consequences of their act. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and produces the case diary. It reflects from the statement of the victim recorded under Section 183 of BNSS that the petitioner was married, had a child and suppressed such fact and committed deception by promising to marry and enjoyed the victim. Having considered the same, I am of the view that the offences complained of prima facie are satisfied. As such, without cross-examination of the victim, I am not inclined to
2 release the petitioner on bail at this stage. Accordingly, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 961 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
