This application has been filed for condonation of delay in filing the appeal against the acquittal of the respondent No.1 in case registered on the basis of complaint filed by the applicant/appellant in case FIR No.54 of 2019 dated 22.11.2019 registered in Women Police Station, Mandi, H.P under Sections 376 (2)(k), 376 (2)(n), 506, 342 of IPC and Section 66-E of IT Act, 2000.
It has been submitted by the learned Additional Advocate General that as per information imparted to him, no appeal has been preferred by the State. The appeal being preferred by the applicant is first appeal against the conviction and for the reason stated in the application and submissions made by the learned counsel for the applicant, as the applicant was not attending day-to-day proceedings before the trial Court
