1. By the present writ petition, the petitioner seeks quashment of the impugned transfer order dated 09.09.2026 (Annexure P/1), insofar as it relates to the petitioner, whereby he has been transferred from District Sakti to District Surguja.

Learned counsel appearing for the petitioner submits that the petitioner is presently working as Tahsildar and has been transferred vide order dated 09.09.2026 from District Sakti to District Surguja on administrative grounds, and respondent No.4 has been posted in his place. He submits that the petitioner has already served for more than five years in the Scheduled/ Tribal Area and is also suffering from 50% permanent locomotive disability. By referring to Clause 1.5 of the circular dated 03.06.2015 issued by the Govt. of Chhattisgarh, learned counsel submits that women employees, persons with disabilities and employees above 55 years of age should, as far as possible, be exempted from posting in difficult Scheduled Areas, unless a person with disability voluntarily opts for such posting. He further submits that the petitioner’s daughter is studying in Class VI at PM Shri Kendriya Vidyalaya, Raigarh. He, therefore, submits that the present petition may be disposed of with liberty to the petitioner to submit a fresh representation before the competent Committee within ten days, with a direction to the said Committee to consider and decide the same within a stipulated period. 3

Learned State counsel fairly submits that if the petitioner submits a fresh representation before the Committee constituted under Clause 8 of the State Transfer Policy, the same shall be considered and decided in accordance with law. 4. I have heard learned counsel for the parties and perused the documents available on record. 5. Considering the nature of the grievance raised by the petitioner and the submission made by learned State counsel, the petitioner is granted liberty to submit a fresh representation before the competent Transfer Committee under Clause 8 of the State Transfer Policy within a period of 10 days. If such representation is submitted within the aforesaid period, the Transfer Committee shall consider and decide the same by passing a reasoned and speaking order, strictly in accordance with law and the applicable Transfer Policy, particularly keeping in view the health issues of the petitioner and the difficulties of his family members, preferably within a period of 20 days from the date of submission of the representation. 6. It is made clear that, till the expiry of the aforesaid period of 30 days, the status quo as it exists today shall be maintained, insofar as the posting of the petitioner is concerned. 7.
